Immigrants who are in the United States for a temporary stay to file Form I765, Application for Employment Authorization to citizenship U.S. and immigration or USCIS to receive an Employment Authorization Document or EAD. The EAD is also known as work permits. U.S. citizens, lawful permanent residents, the status of permanent residents and non-immigrants who are authorized to work in the U.S. should not use the Form I765, Application for Employment Authorization. You can work in the United States while your green card applications pending.

If you want to work while your green card application is pending, you must file Form I765, Application for Employment Authorization with your demand adjustment of status. With the I765 form, you must submit a copy of your I-94, Arrival Departure Card. Upon submission of your application with USCIS you should receive an employment authorization card within 90 days. Once you have received employment authorization card are you entitled to work United States, even if your green card application is pending.

If for some reason you do not receive the Employment Authorization card within 90 days, you can request a temporary employment authorization on Form I765, which will be valid for 240 days. To receive a temporary card, you must file an application of a temporary work permit on Form I765 USCIS Service Center. If 240 days pass and you still have not received a final decision on your I765 application, you must stop working. Temporary work permit cards can be renewed. However, if you reach this point, you can to file a new application for employment authorization on Form I765. If you do not receive a decision, even on implementing new I765 within 90 days, you will be entitled to another card with a temporary work permit.

There is no fee for filing Form I765 when submitted at the same time as Form I-485 application for change of status. It is recommended to file the Form I765, Application for Employment Authorization and Form I-485 application for adjustment of status that allows it to work while your green card application is in progress and also facilitates the implementation ease of application.

You can check the status of your online form I765. If your application for employment authorization on Form I765 is denied, you will be sent a letter to the USCIS explaining why your request was rejected. You may ask officers USCIS to review your case.

Form I765 is used even for the renewal of EAD, replacing the interim EAD and EAD. If have filed your application for adjustment of status from September 2007 and July 30 have paid the application fee for Form I-485, you are not required to pay any tax, while calling for an employment authorization on Form I765. If you file Form I765 separately, you must submit a copy of Form I-797C as a proof of filing Form I-485 application for change of status.
